Real Estate Attorneys

Title Companies and Lawyers

Do You Need a Title Company, an Attorney or Both?

The process of purchasing a home can seem very confusing if you don't know which professionals to call on for assistance. It is a good idea to begin with the state regulations for real estate transactions. Some states require an attorney to close a real estate deal, while in other states a title company presides over the transaction.

In California, a title company is all that is required. However, you may choose to hire an attorney to represent your best interests. Hiring a real estate attorney is a minimal expense that could be well worth the piece of mind it provides you. Without an attorney of your own, no one is looking out for your best legal interests.

If something unusual comes up in the closing, it would be good to have an attorney in your corner. Your attorney will advise you on all phases of the real estate transaction, including purchasing title insurance and reviewing the contract for you.

Why You Need Title Insurance

Owner's title insurance protects you against financial loss caused by covered title risks. Many title problems can cause the complete or partial loss of your home or property. Even the most careful search of public records will not find every lien or encumberance to a property title. If someone presents a legitimate challenge to your title, you may face losing your property.

The title insurer, without expense to you, will defend you against an attack on the title to your property. The title insurer will indemnify you against the defined financial loss up to the policy limit.
